Hemp for Food and Industrial Use

If you are or wish to be in the hemp and cannabis business for medicinal and therapeutic purposes and are looking to expand your operations, the Government of Costa Rica has signed and approved two regulations of Law 10113, Law of Cannabis for Medicinal and Therapeutic Use and Hemp for Food and Industrial Use. The first regulation signed by the President, includes within its scope the rules and requirements to produce Hemp for industrial and food use. This new regulation grants two types of authorizations for companies that want to develop and produce hemp in Costa Rica, for a period of six years renewable for identical periods, which are:

Authorizations for hemp cultivation, production and related activities regulated and granted by the Ministry of Agriculture and Livestock.

Authorizations for the manufacture of hemp derivatives and products of sanitary interest with hemp, regulated and granted by the Ministry of Health.

Such authorizations require:

The Ministry of Agriculture and Livestock or the Ministry of Health will verify that the applicant has the Environmental Registration D2, municipal permits and other procedures required to carry out agricultural production activities.

The Ministry of Agriculture and Livestock or the Ministry of Health will verify that the applicant is registered as an employer and is up to date in all obligations with the Costa Rican Social Security Fund (CCSS).

The applicant must present proof that he/she has an occupational risk policy.

Proof of transparency and of the lawful origin of their capital. The interested parties must submit the information required by the competent department.

The interested party must issue a document in which he/she expressly authorizes the Ministry of Health or the Ministry of Agriculture and Livestock to verify the veracity of the information and carry out inspections in their farms and facilities and take samples of crops and products as part of their duties of control, supervision and prevention of illegal activities.

Hemp cultivation and production licenses will be inexpensive and widely available in Costa Rica, according to the regulations approved by the government. Costa Rica’s rules set the THC limit in hemp at 1.0%, which means that CBD production in the country will be more efficient because CBD increases in hemp plants in proportion to THC. Most countries in the world follow a generally accepted limit of 0.3 % THC as a legal barrier, but some countries in Latin America and Asia are adopting the 1.0 % threshold as the dividing line between hemp and marijuana. Recreational use is not approved yet although there have been several proposals.

Who will be able to get a license?

Individuals and legal entities are authorized to grow and process hemp, according to the framework, which establishes and centralizes specific rules for post-harvest, storage, transportation, product processing, marketing, import and export of health, food and industrial products.
